Merchant Agreement

These Merchant Terms govern your business's use of the I am Ballito platform. By creating a business account you agree to these Terms in addition to our consumer Terms of Use and Privacy Policy.

1. Listing approval

Listings are reviewed within 24 business hours. We may decline a listing for incomplete information, unverifiable contact details, or content that breaches our content standards.

2. Plans and fees

• Free — 1 active coupon, 1 active stamp card, mechanisms A and B, 1 staff member, basic analytics, no push.
• Pro — R299/month — unlimited coupons and stamps, mechanism C, 5 staff, detailed analytics, 4 push campaigns/month.
• Premium — R599/month — everything in Pro plus 12 push campaigns/month, boosted placement, custom branding.

Plans renew monthly. Tier limits are enforced both client-side (UI hints) and server-side (Functions). We may adjust plan benefits with 30 days' notice; pricing changes apply only to new billing cycles.

3. Payments

Payments are processed by Paystack (primary) or Peach Payments (fallback). Paystack settles weekly to your registered bank account. We never see your card details.

4. Coupon and stamp obligations

• You must honour every redemption issued by our platform within the validity window.
• You may not list coupons you cannot fulfil, or impose terms not shown on the coupon detail page.
• Stamp-card rewards must be honoured for at least 6 months from the date the card is filled.

5. Customer data

We share with you only the aggregate redemption data needed to operate your loyalty programme — never personally identifiable consumer information unless that consumer has given specific consent (e.g. by following you for push). You agree to use any such data only for the purposes for which it was shared.

6. POPIA roles

For your customers' transactional data captured through our platform, we are the Responsible Party and you are not. For any list of your own existing customers that you separately import or maintain, you are the Responsible Party.

7. Termination

Either party may terminate at the end of any billing cycle on 7 days' written notice. We may suspend immediately for breach.

8. Limitation of liability

Our liability to your business is limited to the fees paid in the preceding 3 months.

9. Governing law

South African law. KZN courts.
